I believe that anyone who is injured or suffers some loss whilst in the process of doing something illegal should be prohibited by law from seeking any compensation.
To prevent people from then shooting someone they don't like in the streets and claiming "he was going to mug me" there would still be a need for the party that did the damage to prove that the "victim" was in the act of doing something illegal. Thus you cannot get away with shooting someone in the street as (a) how do you prove what he was going to do and (b) why did you have a gun with you?. But letting a guy bleed cos he snagged his bollox on ya glass when breaking in would be acceptable.
